The Presidency of the Council published a note on the state of play of two current legislative proposals: the F-Gas Regulation and Ozone Depleting Substances (ODS) Regulation.

On 5 April 2022, the European Commission published a legislative proposal that would repeal and replace the 2009 Regulation on Ozone-depleting substances (ODS). The proposal introduces no notable changes relevant for the HVACR sector. It maintains the general prohibition on ODS and the applicable exemptions such as for feedstocks.
The Parliament adopted its negotiating position on 7 March 2023; the Council on 5 April. The trilogues have been ongoing since April. A partial agreement was found on 13 June on the core of the proposed Regulation on ODS. The remaining provisions, equivalent to those in the F-Gas Regulation, will be discussed and finalised in the F-Gas negotiations.
