On 15 July 2021, authorities from five Member States registered under the REACH Regulation their intention to submit a restriction request on the manufacture, placing on the market and use of per- and polyfluoroalkyl substances (PFAS) in non-essential applications. PFAS covers an extremely broad range of substances, which may include HFCs and HFOs used as refrigerants in HVACR equipment.
Two public consultations were held in 2021 and 2022 to gather evidence on the use of these substances and all information received was examined. On 13 January 2023, these five Member States finalised and submitted their PFAS restriction proposal to European Chemicals Agency (ECHA). ECHA will publish the proposal on 7 February 2023 and has planned a six-month consultation starting on 22 March 2023. In addition, an online information session will be organised on 5 April 2023 to explain the restriction process and help those interested in participating in the consultation.
ECHA will carry out a scientific evaluation of the proposal, which may take 12 months or more. Once the scientific evaluations are adopted, they are sent to the European Commission, who together with the EU Member States will then decide on a potential restriction.
