Revised reporting obligations on hydrofluorocarbons following the Kigali Amendment to the Montreal Protocol (GEN – 993.00)

GEN – 993.00. The Montreal Protocol decision XXX/10 revises the reporting forms to be prepared by its Parties, including EU and its Member States. The revised forms require, inter alia, detailed data on HFC-23 production/by-production and emissions, as well as on imports and exports of polyols containing hydrofluorocarbons. To ensure compliance with that Montreal Protocol decision it is necessary to revise the Implementing Regulation 1191/2014 and add the new elements.

Draft Commission Implementing Regulation

This draft provides the details to report on import and exports of polyols. The consultation on this draft is open until 22 February 2019.

Relevance

This draft is relevant to the companies that must report about the production, import, export, feedstock use, and destruction of the substances listed in Annex I and II of the F-Gas Regulation.

The yearly reporting must be achieved by 31 March of the year.

Brexit

At the end of 2018, the Commission published Regulation 201/1992 that amends the Regulation 1191/2014 to account for the Brexit. By 31 March, it may impact reporting activities of those companies that are also active in Great Britain.

Recommended Actions

Manufacturers who are obliged to report under the F-Gas Regulation are recommended to take note of the introduction of the additional requirements.
