Eurovent Information Bulletin (Issue 40, 1/2021) published (GEN – 1195.00)

GEN – 1195.00. In cooperation with Orgalim, the Eurovent Team regularly provides you with an in-depth overview on all European legislative developments of relevance for the HVACR sector. The Bulletin provides for a hands-on compendium allowing the industry to assess the status quo and expected future developments. In addition to recent sector specific issues, our Team has summarised some of the key takeaways within this article.


The issues listed below are sometimes subject to postponements due to the COVID-19 outbreak.

EU Multiannual Financial Framework (MFF 2021-2027) and Recovery and Resilience Plan (Next Generation EU)

Both the MFF and Next Generation Plan have been adopted at the end of 2020.Member States must prepare national recovery and resilience plans for the years 2021-23 and this before 30 April 2021. The guidance document encourages Member States to spend at least 37% of their funds on green investments, and a minimum of 20% on digital transformation.

New Legislative Framework (NLF) – Blue Guide

The process started with the publication of a Roadmap /Inception Impact Assessment. The upcoming evaluation will cover aspects of the NLF, except the provisions of the Regulation (EC) No 765/2008 relating to market surveillance which were already revised. The latter is the Market Surveillance Regulation (EU) 2019/1020 that will replace the (EC) 765/2008 provisions from of July 2021.  The article 9 in (EU) 2019/1020 allows Market Surveillance Authorities to agree with other relevant authorities or with organisations representing economic operators or end users to carrying out joint activities to promote compliance.

The revision of the Blue Guide is running in parallel with the NLF evaluation and the revised Blue Guide is expected by the end of July 2021.

Package on Artificial Intelligence (AI)– Machinery Directive

The package will include elements of digitisation, cybersecurity, etc., and in view of the increasingly intelligence of machinery the proposal to revise the Machinery would fir in the Package on IA.

EU – UK (Brexit)

On 24h December 2020 a Trade and Cooperation Agreement was reached. It provides zero tariffs and zero quotas on and goods that comply with the appropriate rules of origin. Despite this agreement, there are important changes since 1 January 2021. The UK has left the EU Single Market and Customs Union. Free movement of persons, goods, services and capital has stopped.

The UK has already ratified the agreement, the provisional EU ratification still needs to be formalised.

Circular Economy Policy and- Ecodesign

Considering the European Green Deal and the Circular Economy Action Plan, the Commission announced a Sustainable Product Policy. This policy aims at increasing producers’ incentives to make products more sustainable, durable and circular with requirements linked to environmental and social aspects. The policy intends to increase the digitalisation of product information.  A roadmap was published, and a public consultation has started.

The revision of the Ecodesign Directive is of concern to the HVACR industry. The proposal intends to extend the scope of the Ecodesign Directive and would include mandatory requirements for recycled content in products, mandatory information and labelling obligations, repairability, and digital product passports. Possibly a Product Environmental Footprint (PEF) methodology may get introduced in the ongoing revision of the Ecodesign methodology (MEErP). This revision is carried out by the European Commission Joint Research Centre and would be available at the of 2021.

Industry associations would be able to live with an overarching framework for specific Ecodesign frameworks, keeping the current Ecodesign framework for Energy Related Products. For other product intended to be part of the extension separate Ecodesign frameworks should apply as it would make no sense to bring for example textile under ERP.

The extension of scope of the Ecodesign framework for Energy Related Products to other products would slow down the preparatory and revision studies. Example for refrigerated display cabinets it took from 2005 to 2019 for regulations to apply from March 2021, 16 years in total, the revision of the fan regulation started in 2014.

The progress on the Ecodesign and energy labelling framework programme2020-2024 is being slowed down because at present there is no Policy Officer to guide the study.
