GEN – 959.00. During the 5th meeting of the Standardisation Market Relevance Roundtable (SMARRT) it was indicated that the standardisation mandate M 129 from 1999 may need to be redrafted to be in line with the Construction Products Regulation 305/2011. Because there are harmonised standards under the Ecodesign Regulations, the need for a standardisation request for the same products under the Construction Products could be questioned.

Background Construction Products Directive/Regulation

The Construction Products Directive (CPD) 89/106 of 1989 was supported by a standardisation mandate M 129 to establish harmonised standards for water heaters, supply of hot and cold water, space heating, cooling and air conditioning to satisfy the six essential requirements.

In practice, none or few harmonised standards under mandate M 129 were published.

The possible update of the mandate M 129 to fit with the seven essential requirements of the Construction Products Regulation (CPR) 2011/305 were discussed in October 2018 during the 5thSMARRT meeting.

The seven essential requirements are:

  • Mechanical resistance and stability
  • Safety in case of fire
  • Hygiene, health and the environment
  • Safety and accessibility in use
  • Protection against noise
  • Energy economy and heat retention
  • Sustainable use of natural resources (introduced by the CPR)

A draft for a revised mandate M 129 is not yet available.

Harmonised standards under Ecodesign Regulations

The mandates under Ecodesign Regulations have resulted in the publication of many harmonised standards for water heaters, space heaters, cooling equipment and air conditioning.

These harmonised standards have proven to be successful in supporting the Ecodesign Regulations and in general cover the energy and environmental requirements that would also be addressed under the revised mandate M 129, if this were to be drafted. 

Recommended Actions

When a revised mandate M 129 would appear, it is recommended that the relevant standardisation Technical Committees (CEN TC 109, 113, etc.) carefully check if such a mandate would be necessary for the products, because the existing standards could already be sufficient.

The Technical Committees would have to argue a possible non-acceptance of the revised mandate M 129. This revision is not expected to appear soon.
