GEN – 771.00. In 2012 it was decided to outsource some of the activities. The Orgalime partnership received the order for collecting and assembling an overview of overall European developments. The latest update is available.

Highlights of the 32-page information bulletin

DG GROW is preparing a new Market Surveillance of Products Package (2.0) which would consist of two legislative proposals including one on enforcement and compliance. The package, expected before the summer break, will consider policy options such as:

  • increasing incentives to comply

  • setting up a digital compliance system

  • increasing deterrence, (e.g. by creating a market surveillance cross-sectoral platform or a Market Surveillance Agency) The package is expected to be released before the summer break.

The Commission has published a brief FAQ on the Radio Equipment Directive (R-ED) RED.  Of note are the texts agreed texts on issues that can also impact on manufacturers of HVAC&R equipment such as:

  • Combined equipment: if the radio equipment is incorporated into a non-radio product in a fixed and permanent manner now of its placing on the market, the RED is applicable to the whole product, simultaneously with other EU legislation which applies to the non-radio product (e.g. the Machinery Directive). In the case of a non-permanent incorporation, each product needs to comply with its own legislation (the RED for the radio product and the MD for the machine).

  • Products in the same packaging: If two products sold together fall under different Directives/Regulations, they should be individually CE-marked and compliant with their own Directive/Regulation.

The Presidency, Council and Parliament hope to achieve an agreement on the revision of the Energy Performance of Buildings before the summer break. In recent proposals, the thresholds under which no periodic inspection is necessary are modified and now concern systems with an effective rated output of 50kW for both heating and cooling.

The revision of the regulations on air conditioners and comfort fans (206/2012 and 626/2011) started in February and a first stakeholder meeting is planned for 5 July 2017. Besides the scope, efficiency and sound power level requirements, it will also address the use of low global warming potential (GWP) refrigerants and resource efficiency aspects (disassembly, recyclability, reparability and durability
